What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The Tenant requested a review of the original order, claiming he was unable to participate in the initial hearing as he was out of the country and did not receive notice.

The ruling

The Tenant's request to review the original eviction order was denied. The Board found that the Tenant was not reasonably unable to participate in the original hearing, as he failed to exercise due diligence in dealing with his mail and tenancy issues while being aware of ongoing rent arrears. The original eviction order remains in effect.
