What happened
Tenant applied for an order determining that Landlord failed to meet maintenance obligations or comply with health, safety, housing or maintenance standards. The rental unit was a new build and the Tenant was the first to occupy it. The Tenant found the unit was not cleaned, closet hardware and doors were not installed, and appliances were not hooked up. The Tenant notified the property manager of the deficiencies but was told the Tenant could not hire their own contractors to do the work as it may void the builder's warranty. After a month without a stove, washer, dryer or dishwasher, and the inability to use the closets, the Tenant moved out to a more expensive unit.
The ruling
The Landlord shall pay the Tenant $346.77 in compensation for the Landlord's failure to maintain the rental unit. The Landlord shall pay the full amount by February 12, 2021, or will owe interest at 2% annually on the outstanding balance.
