What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to non-payment of rent. The Landlord served a valid N4 Notice, which the Tenants did not void. The Tenants were not present at the hearing, but the Landlord's representative presented an agreement reached between parties. The LTB issued a conditional order based on the terms explained by the Landlord's representative.
The ruling
The Tenants are ordered to pay the Landlord $8,076.00 for rent arrears and costs. The eviction application is denied on the condition that Tenants pay $500.00 monthly installments from December 1, 2022 to March 1, 2024, with a final payment of $76.00 by April 1, 2024. Tenants must also pay regular monthly rent on time. If Tenants default, the Landlord may apply for eviction within 30 days of the breach.
