What happened

The landlord applied for an order to terminate the tenancy and evict the tenant due to non-payment of rent. The tenant disputed the monthly rent amount claimed by the landlord, stating that the original lease he signed was for a lower amount. The tenant also claimed he did not receive the N4 notice properly served by the landlord.

The ruling

The Landlord's application is dismissed. The Tenant's T1, T2 and T6 applications should be heard with any L1 application properly filed and served by the Landlord on the Tenant. The arrears of rent cannot be properly calculated if the monthly rent amount is the subject of a dispute.
