What happened
The Landlord applied to terminate the tenancy of the Tenant to perform extensive renovations and repairs, including adding a second-floor washroom and addressing alleged water leaks. The application was heard alongside three other similar applications for the same building. The Tenant contested the application, alleging bad faith and that the repairs did not require vacant possession. The Tenant also highlighted that the Landlord had previously attempted to evict the tenants with multiple N13 notices and had expressed a desire to move long-term tenants out to increase rent to market rates.
The ruling
The Landlord's application to terminate the tenancy for renovations was dismissed. The Adjudicator found that the Landlord failed to prove the renovations were necessary, intended in good faith, or required vacant possession. As the application was dismissed, the Tenant was ordered to return the three-month compensation previously provided by the Landlord.
