What happened

The Landlord applied for an order requiring the Tenant to pay rent arrears. The Tenant vacated the rental unit on July 31, 2025, after providing notice on June 23, 2025. However, since the Tenant was on a month-to-month lease, he was legally required to provide 60 days' notice. The LTB found that the earliest lawful termination date was August 31, 2025. The Landlord successfully mitigated losses by re-renting the unit for September 1, 2025, and the Tenant was held liable for rent until the end of August.

The ruling

The Tenant is ordered to pay the Landlord $1,438.62 by October 21, 2025. This amount represents rent arrears and daily compensation up to August 31, 2025, and the application fee, minus the rent deposit and accrued interest. The Tenant's liability extended beyond his move-out date because he failed to provide the legally required 60 days' notice.
