What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to the Tenant substantially interfering with the reasonable enjoyment or lawful right, privilege or interest of the Landlord or another tenant. The Landlord served two N5 notices on the Tenant for various complaints of noise, yelling, and aggressive behavior, but the Tenant's behavior did not improve.

The ruling

The tenancy is terminated effective November 27, 2023. The Tenant must vacate the unit by that date. The Tenant owes the Landlord $3,951.39, which includes compensation for use of the unit and the application filing fee, less the rent deposit and interest owed to the Tenant. If the Tenant does not pay the full amount by November 27, 2023, they will owe interest at 7% annually on the outstanding balance.
