What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Landlord served a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant requested to preserve the tenancy but had no proposal to pay the arrears or future rent.

The ruling

The tenancy is terminated unless the Tenant voids the order by paying $4,943.51 by March 27, 2023. If not voided, the Tenant must move out by March 27, 2023, and pay $1,987.15 plus $33.25 per day from February 3, 2023, until move-out. The Tenant may make a motion to void the order under section 74(11) of the Act if full payment is made before the Sheriff enforces eviction.
