What happened

The Landlord applied to terminate the tenancy and evict the Tenant because the Landlord intends to convert the rental unit to a non-residential use. The Tenant's legal representative argued that the Landlord failed to pay the required compensation to the Tenant by the date of termination indicated in the N13 Notice, the N13 Notice is defective, and the N13 Notice does not list Martha Elahie as a tenant.

The ruling

The Landlord's application is dismissed because the Landlord failed to meet the requirements of the Residential Tenancies Act, 2006 to compensate the Tenant an amount equal to one month of rent before the termination date or offer another rental unit acceptable to the Tenant.
