What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Tenant did not pay the full rent owed from January 1, 2020 to May 31, 2021, and the Landlord served a Notice of Termination effective January 21, 2020.

The ruling

The tenancy between the Landlord and the Tenant is terminated as of December 31, 2020, when the Tenant gave vacant possession back to the Landlord. The Tenant shall pay the Landlord $8,723.52, which represents the amount of rent owing and compensation up to December 31, 2020, less the rent deposit and interest the Landlord owes on the rent deposit. The Tenant shall also pay the Landlord $190.00 for the cost of filing the application. If the Tenant does not pay the full amount owing by June 15, 2021, the Tenant will start to owe interest at 2.00% annually on the outstanding balance.
