What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants due to non-payment of rent. The Tenants failed to attend the hearing despite being properly served. While the Tenants made significant payments totaling $5,745.00 after the application was filed, arrears remained outstanding at the time of the hearing. The adjudicator found the N4 notice valid and determined that relief from eviction was not warranted given the lack of evidence from the Tenants regarding their circumstances.

The ruling

The tenancy is ordered terminated unless the Tenants void the order by paying the full arrears and costs. To void the order, the Tenants must pay $4,113.11 by July 31, 2025, or $6,076.45 by August 9, 2025. If the Tenants do not void the order, they must move out by August 9, 2025. Failure to vacate will allow the Landlord to enforce the eviction through the Sheriff starting August 10, 2025. If the tenancy is terminated, the Tenants owe a balance of $1,756.61 to the Landlord plus daily compensation of $64.55.
