What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant due to the need to perform major repairs and renovations to the rental unit that require the unit to be vacant. The Landlord served the Tenant with an N13 notice on March 3, 2023, giving a termination date of July 31, 2023.

The ruling

The tenancy is terminated effective December 11, 2023. The Landlord must provide the Tenant with a new cheque for three months' rent as compensation by December 11, 2023. If the unit is not vacated by December 11, 2023, the Landlord may file the order with the Court Enforcement Office for enforcement, and the Tenant must pay the Landlord $33.26 per day for use of the unit after November 17, 2023.
