What happened

The Landlord filed for eviction due to non-payment of rent. The Tenant admitted to withholding rent since December 2024 because of an alleged mold issue. The Tenant's attempt to raise this issue at the hearing under section 82 of the RTA was denied by the Board because the Tenant failed to provide the required advance written notice to the Landlord and the Board. Consequently, the Board issued a conditional eviction order.

The ruling

The Board issued a conditional order terminating the tenancy. The Tenant can void the eviction by paying $9,186.00 by May 31, 2025, or $10,686.00 by June 30, 2025. If the Tenant fails to pay and vacates by the termination date of June 30, 2025, they must pay the Landlord $6,791.51 plus daily compensation of $49.32 from May 14, 2025. The Tenant's attempt to raise a mold issue was dismissed on procedural grounds.
