What happened

The Landlord applied to terminate the tenancy after the Tenant breached a condition of a previous LTB order from June 26, 2025. The Tenant failed to make a $1,500.00 payment and failed to pay July rent. The Tenant moved to set aside the resulting eviction order, claiming funds were arriving from overseas and an employment settlement, though no proof was provided and the Tenant remains unemployed.

The ruling

The LTB denied the Tenant's motion to set aside the eviction order issued on July 23, 2025. The Board found that the Tenant breached a previous payment plan and offered no reliable evidence of future ability to pay. Consequently, the stay of the eviction order was lifted immediately, allowing the Landlord to proceed with the eviction.
