What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to the need to do major repairs or renovations to the rental unit. The Landlord served an N13 Notice on the Tenant with a termination date of May 31, 2021. The Notice stated that the Landlord plans to undertake repairs and renovations including removing and disposing of asbestos materials, removing and replacing plumbing pipes and fixtures, updating the electrical system, and replacing the kitchen, bathroom and finishes.

The ruling

The tenancy is terminated effective March 31, 2022. The Tenant must vacate the unit by that date. The Tenant shall pay the Landlord $5,417.88 in compensation for use of the unit from June 1, 2021 to March 3, 2022, with any rent payments made during that period to be offset. The Tenant shall also pay $19.63 per day from March 4, 2022 until the date the Tenant vacates. If the Tenant does not pay the full amount by March 31, 2022, interest will accrue at 2% annually on the outstanding balance.
