What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to the need to do major repairs or renovations to the rental unit. The Landlord served an N13 Notice on the Tenant with a termination date of May 31, 2021. The Landlord plans to undertake the following repairs and renovations: remove and dispose of asbestos materials, remove and replace plumbing pipes and fixtures to repair water leaks, update the electrical system, and replace the kitchen, bathroom and finishes.

The ruling

The tenancy is terminated effective March 31, 2022. The Tenant must vacate the unit by that date and pay the Landlord $5,517.24 in compensation for use of the unit from June 1, 2021 to March 3, 2022, plus $19.99 per day from March 4, 2022 until the Tenant vacates. If the Tenant does not pay the full amount by March 31, 2022, the Tenant will owe interest at 2% annually on the outstanding balance.
