What happened
The Landlord applied for eviction and rent arrears following the Tenants' failure to pay rent. The Tenants had a significant amount of arrears, exacerbated by the fact that one tenant was incarcerated and the household had no current income. The Landlord was also experiencing financial hardship and mortgage payment difficulties. During the hearing, the Landlord admitted to illegally collecting a damage deposit and agreed to certain rent reductions previously negotiated with the tenants.
The ruling
The tenancy is terminated effective September 30, 2025, unless the Tenants pay $18,886.00 by August 31, 2025, or $23,086.00 by September 30, 2025, to void the order. If the Tenants do not void the order and fail to vacate, they are ordered to pay the Landlord $12,807.53 plus daily compensation of $144.66. The calculation includes a deduction for a $1,000.00 illegal damage deposit and a $3,500.00 rent reduction credit.
