What happened
The Landlord applied to terminate the tenancy for non-payment of rent. A previous order (May 2, 2025) mandated a payment plan for $35,848.50. The Board initiated a review (BIR) because the ordered amount exceeded the LTB's $35,000.00 monetary jurisdiction. While the review was pending, the Landlord filed an L4 application alleging the Tenants breached the previous order by failing to pay. During the de novo hearing, the parties consented to a settlement.
The ruling
The Board cancelled the previous order due to a jurisdictional error regarding the monetary limit. By consent of the parties, the tenancy is terminated effective July 19, 2025. Tenants are ordered to pay $35,000.00 to the Landlord by that date. The Landlord waived the arrears balance exceeding $35,000.00. Failure to vacate allows the Landlord to file for eviction with the Sheriff starting July 20, 2025.
