What happened
The Landlord applied to terminate the tenancy because the Tenant was persistently late in paying rent. Evidence showed rent was paid late 9 times between November 2023 and January 2025. Although the Tenant was late again in February 2025, they had paid on time from March to June 2025. The Landlord requested a conditional order rather than immediate eviction.
The ruling
The tenancy continues on the condition that the Tenant pays the full monthly rent on time from July 1, 2025, to August 1, 2026. If the Tenant fails to pay on time during this period, the Landlord may apply for an eviction order without further notice to the Tenant. The Tenant is also ordered to pay the Landlord $186.00 for the application filing fee by July 15, 2025.
