What happened

The Landlord applied to terminate the tenancy because the Tenants were persistently late in paying rent. Evidence showed the Tenants were late 10 out of 12 times in 2024. However, since the N8 notice was served, the Tenants improved their payment history, paying on time from February to June 2025. Given their 16-year tenure, the adjudicator granted relief from eviction conditional on future timely payments.

The ruling

The application for eviction is denied provided the Tenants pay their rent on time for the next 12 months (July 2025 to June 2026). The Tenants must also pay the Landlord $186.00 for the application filing fee by June 24, 2025. If any rent payment is missed or late during the 12-month period, the Landlord may apply for an ex parte eviction order under section 78.
