What happened
The Landlord applied to terminate the tenancy and evict the Tenant for non-payment of rent. The Tenant failed to attend the hearing. Evidence showed the Tenant made a significant payment of $4,530.00 after the application was filed, indicating an intention to maintain the tenancy, but continued to fall behind on full monthly rent payments. The Landlord also withdrew a claim for NSF charges which were found to be administrative fees rather than cheque-related costs.
The ruling
The tenancy is terminated unless the Tenant pays $1,431.00 on or before November 30, 2025 (or increased amounts for later dates) to void the order. If the Tenant fails to pay and does not move out by January 4, 2026, the Landlord may enforce the eviction starting January 5, 2026. The Member noted the Tenant's recent significant payment as a reason for extending the move-out date.
