What happened
The Tenant filed a motion to set aside an eviction order after paying the necessary arrears and costs to void the order under Section 74(11) of the Act. The previous order had failed to account for a $390.00 payment. The Tenant paid over $15,000 to cover arrears, future rent, NSF fees, and the filing fee, leaving only a small balance for sheriff enforcement costs.
The ruling
The Board ordered that the previous eviction order (LTB-L-082865-24) is void and cannot be enforced if the Tenant pays the remaining $31.35 in sheriff enforcement costs by September 30, 2025. Failure to pay this balance by the deadline will result in the eviction order becoming enforceable.
