What happened

The Tenants requested a review of two eviction orders issued for non-payment of rent. The Tenants argued that the hearing member erred in assessing evidence regarding an alleged agreement to trade renovations for rent credits and failed to apply equitable set-off. The Landlord maintained that there was insufficient evidence of such an agreement. The LTB Vice Chair found no serious error in the original adjudicator's assessment and denied the review request.

The ruling

The request to review the original eviction orders is denied. The original orders issued on July 16, 2025, which terminated the tenancy due to non-payment of rent, remain in full force and effect. The adjudicator found no serious errors in how the evidence was handled or how the law was applied in the initial hearing.
