What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant was in possession of the rental unit as of the hearing date.

The ruling

The tenancy is terminated effective November 30, 2021. The Tenant must pay $3,676.25 to the Landlord, which includes rent arrears, NSF cheque charges, and the application filing fee. If the Tenant pays $4,796.15 by November 30, 2021, the eviction order will be void and the tenancy will continue. If the Tenant does not pay the full amount by November 15, 2021, they will owe interest on the outstanding balance.
