What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant had not paid the full rent for the period from November 1, 2019 to October 31, 2020.
The ruling
The tenancy is terminated effective October 25, 2020, unless the tenant pays $575 on or before that date to void the eviction order. The landlord is authorized to offset $39.29 per day for compensation for the tenant's use of the unit starting October 15, 2020 until the tenant moves out, and $190 for the cost of filing the application. The tenant may make a motion to set aside the order if they pay the required amount after October 26, 2020 but before the Sheriff enforces the eviction.
