What happened
The Landlord applied to terminate the tenancy and evict the Tenant due to rent arrears. The Tenant admitted to the arrears, explaining he had lost his job in July 2024 but recently secured new employment. The Landlord was willing to accept a payment plan but insisted on an immediate payment of May rent, which the Member found unreasonable given the Tenant's first paycheck date.
The ruling
The tenancy is allowed to continue provided the Tenant pays $5,091.12 in arrears and fees according to a specified bi-weekly schedule starting May 23, 2025. Additionally, the Tenant must pay May 2025 rent by May 9, 2025, and subsequent rent on time. If the Tenant fails to make any payment, the Landlord may apply for an eviction order without further notice to the Tenant.
