What happened

Tenant 2 requested a review of an eviction order issued on October 16, 2025, on the grounds that she had filed a consumer proposal under the Bankruptcy and Insolvency Act (BIA) on September 12, 2025, prior to the original hearing. The Board determined that the filing created a stay of proceedings regarding pre-filing arrears and prohibited the termination of the tenancy. However, the Board found that the stay did not protect the joint tenant, Tenant 1, from debt recovery efforts for the rent arrears.

The ruling

The previous hearing order for eviction is set aside. Tenant 2's consumer proposal prevents the termination of the tenancy for arrears owed as of September 12, 2025. Tenant 1, who is not protected by the consumer proposal, is ordered to pay $1,940.41 in rent arrears to the Landlord by November 30, 2025. No eviction is ordered at this time.
