What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants alleging that Tenant 3 committed an illegal act by stealing a package from the residential complex lobby. The Landlord relied on security camera still images and an alleged verbal admission from Tenant 3 during a management meeting. Tenant 3 denied the theft, stating the package she was carrying was a personal return and that she had only handled other packages briefly to check for her own address.

The ruling

The Landlord's application to terminate the tenancy based on an alleged illegal act (theft) is dismissed. The Adjudicator found that the evidence provided by the Landlord did not sufficiently prove that the Tenant took a package belonging to another resident.
