What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had not paid the total rent they were required to pay from November 1, 2019 to February 28, 2021.
The ruling
The tenancy is terminated effective February 23, 2021. The Tenants must pay the Landlord $3,546.03, which includes rent arrears up to the termination date and the application filing fee, less the rent deposit and interest. The Tenants must also pay $47.71 per day in compensation starting February 13, 2021 until they vacate the unit. If the Tenants pay $5,999.80 on or before February 23, 2021, the eviction order will be void and the tenancy will continue.
