What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to rent arrears. The Tenant raised a preliminary issue claiming that the rent was unlawfully increased in 2023. The Board found that the Tenant provided insufficient evidence to support the claim of an unlawful rent increase and proceeded to the merits of the non-payment application. The Landlord served a valid N4 notice, and substantial arrears remained outstanding at the time of the hearing.

The ruling

The tenancy is terminated effective July 18, 2025, unless the Tenant pays $3,397.80 to void the order. If the Tenant does not pay and does not move out by the termination date, the Landlord may enforce the eviction through the Sheriff starting July 19, 2025. While the hearing date accounting showed a technical credit due to the last month's rent deposit, the total required to void the order includes all rent owing up to July 31, 2025.
