What happened

The Landlord applied to terminate the tenancy and evict the Tenant due to substantial interference with reasonable enjoyment and willful or negligent damage to the property. Specifically, the Tenant removed mesh from the unit twice and threw an object from the balcony. The Tenant failed to remedy the behavior or pay the required repair costs within the voiding period of the N5 notice.

The ruling

The LTB ordered the termination of the tenancy effective July 20, 2025, due to the Tenant's repeated removal of unit mesh and throwing objects from the balcony. The Tenant is ordered to pay $6,589.30 to the Landlord, which covers compensation for occupation until the hearing date, repair costs for damages, and the application fee, minus the rent deposit and interest. Daily compensation of $57.25 applies until the Tenant vacates.
