What happened

The Landlord sought a review of a previous order that granted conditional relief from eviction. The Landlord had originally applied to terminate the tenancy because the Tenants transferred occupancy to unauthorized persons without consent. The previous order found that while an unauthorized transfer occurred, the Tenants had since returned to the unit and were granted relief from eviction via a conditional order. The Landlord argued that the Tenant was not credible and that eviction should have been the only remedy.

The ruling

The Landlord's request for a review of the order dated July 9, 2025, is denied. The original order, which provided the Tenants with conditional relief from eviction despite an unauthorized transfer of occupancy, remains in full force and effect. The LTB found that the original adjudicator's findings on credibility and the decision to grant relief were reasonable and did not contain serious errors.
