What happened

The Landlord applied to terminate the tenancy and evict the Tenants and Unauthorized Occupants on the grounds that the Tenants transferred occupancy of the rental unit to the Unauthorized Occupants without the Landlord's consent. The Tenants had traveled to Afghanistan for a family emergency and left the unit in the possession of the Tenant's brother and his family for several months.

The ruling

The LTB found that the Tenants breached the Act by allowing unauthorized occupants to live in the unit while they were abroad. However, the tenancy is ordered to continue provided that the Tenants do not transfer occupancy without consent again. The Tenants must pay the Landlord $201.00 for the filing fee by July 20, 2025.
